Terms of Service

These terms are a plain-language agreement between you and Tendwell ("we", "us") for using tendwellapp.com and the Tendwell app. By creating an account or using Tendwell, you agree to them.
1. Tendwell is a venue, not the contractor
Tendwell helps Fallbrook-area residents find, message, get quotes from, and schedule independent home-service professionals ("pros"). We do not perform any work. Pros are independent businesses, not our employees or agents. Any agreement for work is between you and the pro. We are not responsible for the quality, safety, timing, legality or price of work, or for what either side does or doesn't do.
2. Pros: licensing, insurance and conduct
Pros are solely responsible for holding every license, registration, permit, bond and insurance policy the law requires for their work (including a California CSLB license for jobs of $1,000 or more in labor and materials, where required), keeping them current, and following all laws. Badges like "License verified" or "Insured" reflect a check we did on a stated date; they are not a guarantee and can go out of date. Residents should confirm a pro's license at cslb.ca.gov before hiring.
3. Your account
Give accurate information, keep your sign-in email secure, and use Tendwell only for lawful home-service purposes. No spam, harassment, discrimination, fake listings or attempts to misuse the platform. We may suspend or remove accounts or content that break these terms.
4. Quotes, bookings and payment
Quotes and bookings in Tendwell are arrangements between you and the pro. Unless we say otherwise in the app, Tendwell does not process payments, and any payment, deposit, refund or dispute is between you and the pro.
5. Reviews policy
- Reviews marked "Booked on Tendwell" can only be left by a customer after a completed booking.
- Neighbor vouches come from residents with a verified local ZIP.
- Reviews must be honest, first-hand and relevant. No paid, incentivized, fake, or retaliatory reviews; no personal info, hate or threats.
- We may hide reviews that break these rules. We don't remove reviews just because they are negative, and pros can't pay to change them.
6. Public-record listings (CSLB data)
Some listings are marked "Unclaimed listing" and are built only from public California Contractors State License Board records (business name, license number, classifications, city and license status as of the date shown). They are not endorsements, and the business has not joined Tendwell. We don't show contact details for unclaimed listings.
Business owners can tap "Is this your business? Claim it" to take over and edit the listing after we confirm ownership, or ask us to remove it by contacting us below. We aim to handle removal requests within 10 business days.
7. Messages and emails
We send service emails (sign-in codes, quotes, messages, booking updates). You can turn off notification emails in the app under Profile. See our Privacy Policy for how we handle data.
8. Disclaimers and limits
Tendwell is provided "as is." To the fullest extent the law allows, we disclaim warranties and are not liable for indirect or consequential damages, or for any work, injury, property damage or loss arising from dealings between users and pros. Our total liability to you will not exceed $100. Nothing here limits rights you have that can't be waived under California law.
9. Changes
We may update these terms; we'll post the new date here and, for big changes, let you know in the app or by email.
10. Governing law
These terms are governed by the laws of the State of California. Disputes will be handled in the state or federal courts located in San Diego County, California, unless the law requires otherwise.
